16) Limitation of Liability

To the maximum extent permitted by law:

we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages;
we will not be liable for lost profits, lost revenue, trading losses, loss of data, or business interruption; and
we will not be liable for any losses arising from reliance on Content or Market Data, including AI-assisted Content.

If liability cannot be excluded under applicable law, our total liability for all claims relating to the Services will be limited to the greater of (a) amounts you paid to us for the relevant Services in the 12 months preceding the event giving rise to the claim, or (b) EUR 100.

Some jurisdictions do not allow certain limitations; in those cases, limitations apply to the fullest extent permitted.

These Terms are governed by the laws of Malta, without regard to conflict-of-laws principles. 22) Miscellaneous

Severability: If any provision is held unenforceable, the remainder remains in effect.
No waiver: Failure to enforce a provision is not a waiver.
Assignment: We may assign these Terms as part of a merger, acquisition, restructuring, or asset transfer. You may not assign your rights without our consent.
Entire agreement: These Terms (and referenced policies) constitute the entire agreement regarding the Services.
